Agreement to Terms

By downloading, accessing, or using JournAI ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Description of Service

JournAI is an AI-powered journaling application that uses conversation-based techniques to help users explore their thoughts and emotions. The Service is provided by Wonderlively ("we", "our", "us").

Eligibility

You must be at least 18 years old to use JournAI. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

Subscriptions and Payments

JournAI offers a limited number of free messages. To continue using the Service beyond the free limit, a paid subscription is required.

• Free Tier: New users receive a limited number of free messages. Once exhausted, a subscription is required to continue.
• Subscription Plans: We offer monthly and yearly subscription plans. Pricing is displayed in the App at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Apple App Store Purchases: If you subscribe through the Apple App Store, payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you turn off auto-renewal in your Apple ID account settings at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your Apple ID account settings on your device. Apple's payment terms apply.
• Web Purchases (Stripe): If you subscribe through our website, payments are processed by Stripe. You can manage your subscription through the billing portal accessible from the App.
• Refunds: Refunds for App Store purchases are handled by Apple in accordance with their refund policies. For web purchases, please contact us at support@journai.ing.

API Keys and Third-Party Services

JournAI allows you to connect your own API keys for enhanced AI functionality:

• You are solely responsible for obtaining, paying for, and managing your own API keys
• You must comply with the terms of service of each third-party provider (Anthropic, Google, ElevenLabs, OpenAI)
• We encrypt and securely store your API keys, but you remain responsible for keeping them confidential
• We are not liable for any charges, damages, or losses incurred through your use of third-party APIs
• Third-party services are subject to their own terms and privacy policies, which may change without notice from us

Your Content

You retain full ownership of all content you create within JournAI, including journal entries, messages, and personal context. We do not claim any ownership rights over your content.

• Your content is encrypted at rest and stored securely
• We do not access, sell, or share your personal journal content with third parties except as necessary to provide the Service (e.g., sending your messages to AI providers for responses)
• You grant us a limited license to process your content solely for the purpose of providing and improving the Service

Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to generate content that is harmful, abusive, or violates the rights of others
• Reverse-engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others or create multiple accounts

Account Termination

You may delete your account at any time through the Settings page. Upon deletion, all your data — including conversations, messages, personal context, AI memories, and stored API keys — will be permanently and irreversibly removed from our systems.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. If we terminate your account for cause, you are not entitled to a refund of any prepaid subscription fees.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We do not warrant the accuracy, reliability, or completeness of any AI-generated content
• AI responses are generated by third-party language models and may contain errors, inaccuracies, or inappropriate content

Limitation of Liability

To the maximum extent permitted by applicable law, Wonderlively and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any AI-generated content or recommendations
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service
• Any charges incurred through your use of third-party API keys

Our total aggregate liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Wonderlively and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wonderlively regarding your use of the Service, and supersede any prior agreements.
